Terms of Service

1. Acceptance of Terms

By accessing or using the XpertWorker platform — the website at xpertworker.com, mobile applications, and all related services (collectively, the "Platform") — you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

These Terms form a binding agreement between you and Veltonor ("XpertWorker", "we", "us"). By registering an account or submitting a booking request, you confirm that you have read, understood, and accepted these Terms in full.

2. Nature of the Platform — We Are an Intermediary

XpertWorker is an online marketplace and technology intermediary that facilitates connections between customers seeking home services ("Customers") and independent, self-employed third-party service professionals ("Professionals").

XpertWorker qualifies as an "intermediary" as defined under Section 2(w) of the Information Technology Act, 2000 and claims the safe harbour from liability afforded to intermediaries under Section 79 of that Act.

3. Definitions

• "Customer" — any individual who uses the Platform to discover and request home services.
• "Professional" — any independent individual or business entity registered on the Platform to offer services.
• "Lead" — the contact details and service requirements of a Customer, shared with one or more Professionals.
• "Booking" — a service request submitted by a Customer through the Platform.
• "Lead Fee" — the fee paid by a Professional to XpertWorker upon receiving a Lead.
• "Platform" — xpertworker.com, mobile applications, APIs, and all related XpertWorker services.
• "User" — any person using the Platform, whether Customer, Professional, or visitor.

4. Eligibility

You must be at least 18 years of age and legally competent to enter into contracts under the Indian Contract Act, 1872. The Platform is intended solely for use within India. By using the Platform, you represent that you satisfy these requirements.

5. Account Registration & Security

Accounts are created via OTP-verified mobile number. You warrant that all information you provide is accurate, complete, and current. You are solely responsible for all activity that occurs under your account. Notify us immediately of any unauthorised access at support@xpertworker.com.

XpertWorker reserves the right to suspend or permanently terminate any account at its sole discretion, with or without notice, for violation of these Terms or for any other reason.

6. How the Platform Works

Customers browse service categories, view indicative pricing, and submit Booking requests. XpertWorker shares the Customer's contact details and service requirements with one or more Professionals in the Customer's area. This sharing is XpertWorker's core service.

Indicative prices displayed on the Platform are estimates for general guidance only. Final pricing is determined by the Professional on-site, based on actual scope of work, parts required, and their individual rates. XpertWorker does not control, set, or guarantee pricing.

XpertWorker does not guarantee that any Professional will be available for, accept, or complete any particular Booking.

7. KYC Verification — Scope and Limitations

XpertWorker requires Professionals to submit government-issued photo identity documents (e.g., Aadhaar, PAN) for KYC verification before listing on the Platform.

8. Payments

XpertWorker never charges Customers. Customers pay Professionals directly upon completion of the service. XpertWorker is not a party to, does not process, and accepts no responsibility for, any payment transaction between a Customer and a Professional.

Professionals pay XpertWorker a Lead Fee upon receipt of each Lead. Lead Fees are non-refundable once a Lead has been delivered, regardless of whether the Professional is engaged. All payment disputes between Customers and Professionals are the sole concern of those parties.

9. Customer Responsibilities

By submitting a Booking, you agree to:

1. Provide accurate, complete, and truthful information about the service required;
2. Ensure safe and unobstructed access to your property at the agreed time;
3. Be present or arrange for a competent adult to be present throughout the service;
4. Inspect all work upon completion before making any payment to the Professional;
5. Raise any concerns about workmanship directly and promptly with the Professional;
6. Independently evaluate each Professional and accept full responsibility for the decision to hire.

10. Professional Responsibilities

By registering as a Professional, you represent, warrant, and undertake that:

1. All information submitted to XpertWorker is accurate, complete, and not misleading;
2. You hold all licences, permits, certificates, and qualifications required by law to perform the services you advertise;
3. You are legally authorised to work in India and to enter into service agreements;
4. You comply with all applicable laws, safety regulations, and professional codes of conduct;
5. You are solely and exclusively responsible for the quality, safety, legality, and outcome of every service you perform;
6. You will treat all Customers professionally, respectfully, and honestly;
7. You will not solicit Customers for repeat business outside the Platform without XpertWorker's prior written consent.

11. Prohibited Conduct

All Users must not:

• Use the Platform for any unlawful purpose or in violation of any applicable law;
• Provide false, fraudulent, or misleading information at any stage;
• Harass, abuse, threaten, intimidate, or discriminate against any other User or XpertWorker staff;
• Post false, defamatory, or manipulated reviews or ratings;
• Reverse-engineer, scrape, copy, or republish any part of the Platform or its content;
• Upload or transmit malware, viruses, or code intended to disrupt the Platform;
• Attempt to gain unauthorised access to any system, account, or data;
• Engage in any activity that imposes an unreasonable load on the Platform's infrastructure.

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied.

You agree to indemnify, defend, and hold harmless XpertWorker and its officers, directors, shareholders, employees, agents, successors, and assigns from and against any and all claims, liabilities, losses, damages, penalties, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to the Platform; (b) your violation of any provision of these Terms; (c) your violation of any applicable law or third-party right; (d) any service you perform or fail to perform as a Professional; or (e) any dispute between you and any other User.

15. Intellectual Property

All Platform content — text, graphics, interface designs, logos, software, databases, trade marks, and service marks — is owned by or licensed to XpertWorker and protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and applicable intellectual property laws. You receive a limited, personal, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purpose only. User-submitted content (reviews, images, etc.) remains your property, but you grant XpertWorker a worldwide, royalty-free, perpetual, sub-licensable licence to display, distribute, and use that content on the Platform.

16. Reviews & Ratings

Reviews must be honest, grounded in genuine first-hand experience, and free from false, defamatory, or harassing content. XpertWorker may moderate, decline to publish, or remove any review at its discretion. Valid takedown requests may be sent to grievance@xpertworker.com.

17. Termination

XpertWorker may suspend or terminate your access to the Platform at any time, with or without cause or notice. On termination, all licences granted to you cease immediately. Sections 12, 13, 14, 18, 19, and 20 survive termination.

18. Dispute Resolution Between Users

Disputes between a Customer and a Professional must first be addressed directly between those parties. XpertWorker may, at its sole discretion, attempt to facilitate communication but is under no obligation to mediate, adjudicate, or provide compensation in any user-to-user dispute. XpertWorker's decisions on complaints are non-binding.

19. Arbitration

Any legal dispute or claim between a User and XpertWorker that cannot be resolved amicably shall be finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted before a sole arbitrator appointed by XpertWorker. The seat and venue shall be New Delhi. The language shall be English. The arbitral award shall be final and binding.

Notwithstanding the above, XpertWorker may seek interim or injunctive relief from any court of competent jurisdiction.

20. Governing Law & Jurisdiction

These Terms are governed exclusively by the laws of India. Subject to Section 19, the courts at New Delhi shall have exclusive jurisdiction over all matters required to be adjudicated in court.

21. Force Majeure

XpertWorker shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, epidemic or pandemic, government action, internet or telecommunications outages, power failures, or civil unrest.

22. Changes to These Terms

XpertWorker may revise these Terms at any time. Material changes will be notified via the Platform or to your registered mobile number at least 7 days before taking effect. Continued use of the Platform after that date constitutes acceptance of the revised Terms.

23. General Provisions

Severability: If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary, and all remaining provisions continue in full force.

Entire Agreement: These Terms, together with the Privacy Policy and Refund & Cancellation Policy, constitute the complete agreement between you and XpertWorker.

No Waiver: Failure to enforce any provision does not constitute a waiver of that provision.

Assignment: You may not assign your rights or obligations under these Terms. XpertWorker may assign without restriction.

Language: These Terms are in English. In case of any conflict, the English version prevails.
